What Is Labour Market Testing (LMT)?

Labour Market Testing is a mandatory step for sponsoring overseas workers under various skilled visa subclasses in Australia. It proves that the employer has made genuine efforts to hire local talent before nominating a foreign worker.

LMT is governed by the Migration Regulation LIN 18/036 and LIN 22/064, which outline how and where jobs must be advertised, and what evidence must be provided.

 

When Is Labour Market Testing Required?

Employers must complete LMT before lodging a nomination for:

  • Temporary Skill Shortage (TSS) visa – Subclass 482

  • Employer Nomination Scheme (ENS) – Subclass 186

  • Regional Sponsored Migration Scheme (RSMS) – Subclass 187

  • Skilled Employer Sponsored Regional (Provisional) – Subclass 494

  • Labour Agreement streams

  • Global Talent Employer Sponsored (GTES) program

  • DAMA & Pacific Australia Labour Mobility (PALM) Scheme roles

 

LMT Advertisement Requirements – What You Must Do

To comply, you must:

Advertise the role on at least two approved platforms for a minimum of 28 consecutive calendar days

  • Mandatory: Workforce Australia

  • Secondary: Seek, Indeed, LinkedIn, or an industry-specific job board

Include in the job ad:

  • Job title and duties

  • Required experience and qualifications

  • Full-time/part-time status

  • Location

  • Salary range

  • Business name or sufficient identifying information
